PERSONAL INJURY -- AUTOMOBILE ACCIDENT
Settlement:
Reached a $1.5 million settlement with an insurance company for a couple who were seriously injured in an automobile accident.
Settlement:
Reached a $1.1 million settlement with several insurance companies for a young mother who sustained horrific damages following an automobile accident. Those damages included physical injuries to herself and her young daughters (ages five and seven) as well as the death of her third trimester unborn child.
Jury Verdict:
Gregory Jones obtained a jury verdict in excess of $7 million dollars for his client who was paralyzed following an automobile accident.
Verdict:
John Guyton obtained a $650,000.00 verdict following a bench trial for his client whose wife was killed by a teenager riding a stolen motorcycle.
WRONGFUL DEATH Settlement:
Reached a $1.4 million settlement with the surviving husband and children of a mother tragically killed in an automobile intersectional collision.
PRODUCT LIABILITY
Settlement:
Settled for $1.3 million a product liability lawsuit for a man who lost his eye while assembling a children's toothbrush for his young son. The batteries exploded in the father's hands while being inserted into the toothbrush. The firm successfully sued both the manufacturer of the toothbrush and the manufacturer of the batteries.
PREMISES LIABILITY
Jury Verdict:
Many Alvarez obtained a $1.3 million verdict from a jury in a slip and fall case for a local law enforcement officer who fell in a puddle of grease while entering a convenience store. The trial court's verdict was affirmed on appeal. With awardable interest and attorneys' fees, the client's final recovery was approximately $1.8 million.
Obtained a $500,000 settlement in favor of a client who was assaulted in his own home as a result of his apartment complex's negligent failure to provide security.
COMMERCIAL LITIGATION
Jury Verdict:
John Guyton concluded 2-1/2 years of litigation against a publicly traded company ( Mobil Mini Inc) after company had interfered with a merger between our client and another company. The matter was tried before a jury which awarded the firm's client $7.5 million for economic losses associated with the wrongful interference. The jury's verdict was confirmed on appeal. With awardable attorneys' fees and interest, the client's recovery exceeded $8 million.
MEDICAL NEGLIGENCE
Jury Verdict:
A prominent Sarasota County orthopedic ordered blood tests for our firm’s client who had a painful and swollen wrist. Despite the SED rate value at 98 (or 400% over its normal value), he wrote in his chart that “All labs are normal.” Unfortunately, the wrist was septic or infected. Many surgical procedures later, the wrist had to be fused.
The jury’s verdict was for our firm’s client for $1,250,000.00. (view verdict)
Settlement:
A total knee replacement with complications. The case was settled for the orthopedic surgeon’s insurance policy limits. The terms are confidential.

Three separate claims for three patients were brought against one plastic surgeon following complications from plastic surgery. Each claim was settled. The terms are confidential.
Settlement:
A confidential settlement was reached against a hospital who failed to properly treat a case of necrotizing fasciitis. The resulting injury was a below the knee amputation.

A confidential settlement was reached following a family practitioner’s failure to diagnose and treat esophageal or throat cancer.
ATV ACCIDENTS
Settlement:
A client of the firm obtained a $4.25 million recovery against the manufacturer of an all-terrain vehicle (ATV). The clients were the mother and father of a young boy who sustained serious injuries when struck by an ATV at a construction site near his home.
EMPLOYMENT CLAIMS
Verdict:
Client of the firm received a judgment exceeding $1 million for harassment and retaliation against a hotel chain.
INSURANCE BAD FAITH LITIGATION
Settlement:
The firm represented an insured who recovered $1.8 million and $650,000 in attorneys' fees from his insurance company for its bad faith failure to settle an automobile liability claim which had been asserted against him.
Settlement:
The firm achieved a settlement of $2.75 million in favor of a hospital against its insurance company as a result of the insurer's bad faith failure to settle a malpractice claim which had been asserted against it.
CONSTRUCTION ACCIDENT
Settlement:
Obtained $400,000 settlement in favor of a client who fell off the balcony of a condo during construction due to negligence of general contractor.
SPOLIATION OF EVIDENCE
Settlement:
Obtained $450,000 settlement for a rental car company after it disposed of vehicle before client could inspect the vehicle.
CIVIL THEFT
Verdict:
Obtained $517,000 judgment in favor of a client against an ex-employee who had embezzled money. |
