John Guyton and Ron Barcena, Jr. win Construction Defect Suit

Attorneys John Guyton and Ron Barcena secured a decisive defense verdict after a four-day trial on behalf of their client, Bevis Concrete, Inc., in a construction defect lawsuit. Bevis Concrete was brought into the case as a Third-Party Defendant by Brantley Construction, Inc.

The Plaintiffs, dissatisfied homeowners, initially filed suit against Brantley Construction for alleged defects in the work performed during the construction of their home. In response, Brantley Construction sought to shift liability to Bevis Concrete, asserting claims for breach of contract, negligence, and common law indemnity.

After a four-day trial, the team achieved a complete victory, with the jury rendering a defense verdict in favor of Bevis Concrete on all counts.

Attorneys Manuel Alvarez, Matthew Holtsinger, and David Hoffman recently won a case with a Motion for Summary Judgment, saving our client the expense and uncertainty of trial. The case involved a slip and fall on a transitory foreign substance at the Defendant’s barbecue restaurant. Plaintiff was alleging to have suffered permanent injuries from this alleged accident. She was claiming over $500,000 in past medical bills and over $800,000 in future medical bills plus non-economic damages. Prior to trial, Defendant filed motion for summary judgment, arguing that the Plaintiff had failed to prove actual or constructive notice of the transitory foreign substance prior to Plaintiff’s fall.

The Judge agreed and granted judgment in favor of the Defendant.
